Construction Design and Management Regulations (CDM): New for 2007
The Health and Safety Commission (HSC) recently announced that they have approved the proposed revised Construction (Design and Management) (CDM) Regulations and Approved Code of Practice (ACoP). The new, simplified CDM Regulations will revise and bring together the existing CDM Regulations 1994 and the Construction (Health Safety and Welfare) Regulations 1996 into a single regulatory package, supported by an Approved Code of Practice (ACOP) and guidance. The new regulations are due to be introduced in April 2007, with an approved Code of Practice (ACOP) due in January 2007.

CDM 2007 can be expected to have a strong industry emphasis, as CONIAC (The Construction Industry Advisory Committee) has been involved in it’s development. HSC members have already discussed the effect of the Regulations on small and medium sized businesses (SMEs). It has been stressed that the new Regulations do not impose new duties on clients, but clarify what clients should already be doing as a result of existing duties in the Health and Safety at Work etc Act 1974 (HSWA) and the Management of Health and Safety at Work Regulations 1999. To help SMEs, clear, uncomplicated guidance is being developed, which will be crucial in helping smaller clients as well as alleviating concerns.
